They Saved The Best For Last...

Confused in the fight over Obamacare about the Federal Government's use of the "Commerce Clause" or the "Necessary and Proper Clause"?
[The Congress shall have Power] To regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes... 
The Congress shall have Power - To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.
Too vague?

How about....the 10th Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

"Prohibited by it to the States" means the States should not being suing the Federal Government in Federal Government court - they should just assert their Rights.

Madison thought the language of the 10th Amendment was, well, assumed, and that this didn't add anything.  As originally drafted, it ended at "...respectively." Upon deliberation, the founders added "...or to the people."

Hamilton said in the Federalist Papers, "..the people...as the natural guardians of the Constitution..." and


As the people are the only legitimate fountain of power, and it is from them that the constitutional charter, under which the several branches of government hold their power, is derived, it seems strictly consonant to the republican theory, to recur to the same original authority, not only whenever it may be necessary to enlarge, diminish, or new-model the powers of the government . . . to the people themselves, who, as the grantors of the commissions, can alone declare its (the Constitution) true meaning, and enforce its observance?


Why are we then, leaving it up to the Supreme Court - which may appear poised to make the right decision...but then again:





...and Thomas Jefferson wrote, "The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants. It is it’s natural manure."

Symptomatic...

Keith Olbermann was fired...again.  The Left fails to acknowledge failure.  It is a character flaw. 

It is what causes them to not want to keep score in children's games, cheating them out of learning how to deal with defeat . . . it is what causes them to want to feed the homeless in the street, which keeps them on the streets . . . it is what causes them to give the poor credit cards instead of food stamps, removing the 'stigma', and making it desirable . . . it is what causes them to want to force banks to lend money to people who don't have the means to pay it back, and then force the banks to restructure the mortgages and take losses . . . it is what causes them to want peace - at the cost of millions of human lives.


A statement from the network's founders Al Gore and Joel Hyatt said it had been founded "on the values of respect, openness, collegiality, and loyalty to our viewers. Unfortunately these values are no longer reflected in our relationship with Keith Olbermann and we have ended it."


Olbermann is a guy with a big intellect, and no intelligence.  But still, after being fired from ESPN, being fired from MSNBC, Algore hired Olbermann with a multi-million dollar contract. 

...only to replace him with Elliot Spitzer, who has also been fired from his last two jobs.

Obamacare on Deathbed...

     What ramifications will this have on the November election? 

Supreme Fight Update:

The government lawyers are making the argument that healthcare is a unique market, and that citizens can be compelled by the government to buy a product, because inaction (not buying a product) is an economic decision. Their example - one never knows when one may be in need of emergency medical care, and one could walk on the bill (or not be able to afford it) after treatment is given - as many do.  Therefore, by not having insurance, the price for individuals is higher than it should be, because some individuals are not paying.

Therefore, everybody is already engaged in the system (by using it at some time), the government (since it is already involved in Medicare and Medicaid) just wants to collect money from everybody in the form of insurance (which can be to a private company...as long as they still exist). 

This ignores the person, I'll call him Mr. Freeman, who pays cash as he goes. Sure, Mr. Freeman enters the market, but he is allowed to exit it, and it is possible that his costs (on a as-needed bases, without insurance) will be below what the government wants to charge him every month, all the time.


Haven't we all been there?  I pay over $500 a month for my medical insurance.  In reviewing my taxes, my out-of-pocket medical bills last year (I cover 8 people!) were a few hundred dollars.  I could have saved the $6,000 I paid in premiums, and been on top.  The last two years, I could have saved over $12,000.  For me, it is not worth the risk.  Yesterday, the littlest Bannon boy had surgery - I'm sure just the anesthesiologist cost more than $6,000.  But for millions of Americans (and me for years after college) - the FREEDOM to choose when to pay, their economic freedom, must be preserved.

How did we get here? How did we go from our founding document, to a situation where the President and (at one point) a majority of our congress believes this is okay?  By the REFUSAL of the Supreme Court to check and balance the Legislature - by granting Congress the ability to 'regulate commerce between the states' - through ANY way possible.  And now, the lawyers for the government are throwing it in Scalia and Breyer's faces...with all due respect.

I am 98% sure, based on the questions the Supremes asked (which were the same questions the 11th and 4th Circuit Court's already asked), that they EASILY recognized the unconstitutionality of this.  The scary part, is that some do not.

What I fear, is that the bill will not be struck down completely.  If they strike down part of it, they leave a partial bill - which is not what congress wanted.  But as I have said before - the Individual Mandate - is NOT the only unconstitutional part of this bill. What about:

Fundamental Change...

That is what Obama promised, and that is what we are facing at the Supreme Court of the United States (often referred to as SCOTUS...but yesterday, I was advised about SLOTUS - anybody know who that is? It was a first for me).

In January, the Supreme Court ruled that law enforcement attaching a 'slap on' GPS device to the outside of a vehicle was a "search" of the vehicle, since the goal was gaining information.  Without delving into the details here - Justice Scalia wrote the majority opinion, and was joined by Roberts, Thomas and Kennedy.  Justice Alito wrote a seperate, concurring opinion joined by Ginsburg, Breyer and Kagan. (Alito's opinion confirmed what I believed before - he may be the smartest among them.  He dismantled Scalia).  That brings us to Sotomayor.  Technically, she joined Scalia...but wrote her own seperate opinion.  Which was scary.


"...In cases involving even short-term monitoring, some unique attributes of GPS surveillance...will require particular attention. GPS monitoring generates a precise, comprehensive record of a person’s public movements that reflects a wealth of detail about her familial, political, professional, religious, and sexual associations..." 

Uh, her what? No, it tells us where her car went - and the point your Honor, is that she can be followed without the GPS.

"...Disclosed in [GPS] data . . . will be trips the indisputably private nature of which takes little imagination to conjure: trips to the psychiatrist, the plastic surgeon, the abortion clinic,the AIDS treatment center, the strip club, the criminal defense attorney, the by-the-hour motel, the union meeting, the mosque, synagogue or church, the gay bar and on and on.."

At which point the cops ask to be re-assigned.


...ANYWAY...yesterday the Court addressed whether the 'individual mandate' was a TAX or a PENALTY.  Obama and the legislatures called it a PENALTY.  Their lawyers called it a TAX because that would make their case in court easier. 

Justice Sotomayor said that the problem was the "inartful drafting by Congress."  We know your Honor, that you will provide an "artful" view of our Constitution in deciding this case.


BTW...I use BING instead of Google.  Why?  Today on the Bing page, they have the Jefferson Memorial - Jefferson, the small government advocate (even if he was a big government actor).  Coincidence?  I think not.

Tommorrow...

...the Supreme Court will hear arguments on the constitutionality of the Patient Protection and Affordable Care Act (aka Obamacare). 

It is a complex case...that is simple. 

Without complicating matters, here are some simple truths:

- The Bill was over 2700 pages long.  It was not read by the people who passed it.

- It passed without a single Republican voting for it, and 34 Democrats voting against it.  Republicans won in a landslide election 7 months later.






One of the simple arguments against, is that the Federal Government can not force a citizen to purchase a product, namely health insurance.  This is not a power given to congress in the Constitution.

CSPAN just had on some of the attorneys that will be arguing the case in front of the court.  One of the attorneys against the bill said, "If you are sitting in your living room not buying anything - congress can not force you to buy something, you are not engaged in commerce that is between the states."

A lawyer for the Government said, "If you are sitting in your living room, you ARE engaged in commerce that is between the states, because you will eventually get sick and require health care."

That scares me.

The worst of all scenarios - that this bill not be shot down completely for the facts listed above.

Other RANDOMLY PULLED sick facts:

  • Impose a $2,000 per employee tax penalty on employers with more than 50 employees who do not offer health insurance to their full-time workers (this is no longer a benefit, its a requirement from the Government)
  • Health insurance companies become subject to a new excise tax based on their market share; the rate gradually raises between 2014 and 2018 and thereafter increases at the rate of inflation. The tax is expected to yield up to $14.3 billion in annual revenue (straight out of Atlas Shrugged - why not call this the "Level the Playing Field" clause)
  • The qualifying medical expenses deduction for Schedule A tax filings increases from 7.5% to 10% of earned income (if this is the affordable care act - why did they increase the amount needed to qualify for a tax deduction?)

The Truth Matters...

...just not in politics.  Tom Hanks says it, it must be true - HE saved us from the brink...and he's not done yet.




  • His economic team didn't know about the economy, until after he won the election - George W Bush was hiding it
  • He saved (and modernized) the auto industry...and the Midwest, and it was a tough decision
  • He finally fixed rising medical costs (rising since the time of black and white TV), and brought us in line with all the other countries - who have better health care than we do
  • He sacrificed his political future, for the betterment of the country, and got the Republicans to not cast a single vote for Obamacare
  • He brought the troops home (the ones in Iraq) and found Bin Laden, despite inconclusive intel, and internal debate
  • Bill Clinton hopes to be like him
  • He restored science
  • He declined the Senate's offer to Advise and Consent
  • He turned warriors into lovers
  • He got raises for women
...and he didn't do this for political gain, he did it...for us

Do Not...

...eat before watching.



Watch her face at 1:40.  You think she is not a True Believer?  She thinks she just exposed an untruth in the Pro-Life argument.  She isolated abortion, put it in a vacuum and removed it from any moral relevance, and explained that if it were truly a goal of "the very same opponents" to end abortions, they would be for GOVERNMENT FUNDED FAMILY PLANNING.

"...family planning has the potential of preventing twenty-five percent of the maternal and child deaths in the developing world..."  Yes, it is true, that if people are never born, they will never die.  Her logic is outstanding, even if her use of statistics is blatently farcical.

[It should be noted that RACE BANNON has no position on contraception, he thinks that is a private matter that the Secretary of State of the United States should not be talking about in public...and that Government action towards (certain) population control, crosses another line altogether...see Hitler, Holocaust, etc.]

On abortion...this is part of the mantra, that it is a "women's health" issue - aren't you for women's health?  How many women out there are sick or dying because they are having a baby?  It is not very healthy for the baby, to be smashed, cut up, and thrown away.  I'm just sayin'...

What Kids Now Learn in College by Dennis Prager

As high school seniors throughout America will be receiving acceptance letters to colleges within the next month, it would be nice for parents to meditate on what they are getting for the $20–$50,000 they will pay each year.

The United States is no better than any other country, and in many areas worse than many. On the world stage, America is an imperialist country, and domestically it mistreats its minorities and neglects its poor, while discriminating against non-whites.

There is no better and no worse in literature and the arts. The reason universities in the past taught Shakespeare, Michelangelo, and Bach rather than, let us say, Guatemalan poets, Sri Lankan musicians, and Native American storytellers was “Eurocentrism.”

God is at best a non-issue, and at worst, a foolish and dangerous belief. Christianity is largely a history of inquisitions, crusades, oppression, and anti-intellectualism. Islam, on the other hand, is “a religion of peace.” Therefore, criticism of Christianity is enlightened, while criticism of Islam is Islamophobia. Israel is a racist state, morally no different from apartheid South Africa.

Big government is the only humane way to govern a country.

The South votes Republican because it is still racist and the Republican party caters to racists.

Mothers and fathers are interchangeable. Claims that married mothers and fathers are the parental ideal and bring unique things to a child are heterosexist and homophobic.

Whites can be racist; non-whites cannot be (because whites have power and the powerless cannot be racist). The great world and societal battles are not between good and evil, but between rich and poor and the powerful and the powerless.

Patriotism is usually a euphemism for chauvinism.

War is ignoble. Pacifism is noble.

Human beings are animals. They differ from “other animals” primarily in having better brains.

We live in a patriarchal society, which is injurious to women. Women are victims of men.

Blacks are victims of whites.

Latinos are victims of Anglos.

Muslims are victims of non-Muslims.

Gays are victims of straights.

Big corporations are bad. Big unions are good.

There is no objective meaning to a text. Every text only means what the reader perceives it to mean. The American Founders were sexist, racist slaveholders whose primary concern was preserving their wealthy status. The Constitution says what progressives think it should say.

The American dropping of the atom bomb on Hiroshima was an act of racism and a war crime.

The wealthy have stacked the capitalist system to maintain their power and economic benefits. The wealthy Western nations became wealthy by exploiting Third World nations through colonialism and imperialism.

Defining marriage as the union of a man and a woman is as immoral as defining marriage as the union of a white and a white.

Some conclusions:

If this list is accurate — and that may be confirmed by visiting a college bookstore and seeing what books are assigned by any given instructor — most American parents and/or their child are going into debt in order to support an institution that for four years, during the most impressionable years of a person’s life, instills values that are the opposite of those of their parents.

And that is intentional.

As Woodrow Wilson, progressive president of Princeton University before becoming president of the United States, said in a speech in 1914, “I have often said that the use of a university is to make young gentlemen as unlike their fathers as possible.”

In 1996, in his commencement address to the graduating seniors of Dartmouth College, the then president of the college, James O. Freedman, cited the Wilson quote favorably. And in 2002, in another commencement address, Freedman said that “the purpose of a college education is to question your father’s values.”

For Wilson, Freedman, and countless other university presidents, the purpose of a college education is to question (actually, reject) one’s father’s values, not to seek truth. Fathers represented traditional American values. The university is there to undermine them.
